  • SKE Engineering GmbH, Gewerbeallee 15d, 4221 Steyregg, Austria is a company in the field of photovoltaics and responsible in the sense of the General Data Protection Regulation (GDPR) (hereinafter "SKE").
  • SKE applies this privacy policy in the processing of personal data of third parties of any kind.
  • This privacy policy applies to all personal data processed by SKE in the course of operating this website, as well as by contacting SKE, and to all personal data processed by SKE's contracted processors.

Legal basis, purpose of data processing and data subjects

  • Personal data will only be processed by SKE in a lawful manner within the meaning of Art 6 DSGVO if one of the legal bases for processing listed in Art 6(1) DSGVO is given.Personal data will therefore be processed by SKE if this is necessary to perform a contract and/or
  • to fulfill a legal or statutory obligation and/or

  • Personal data is processed primarily in the context of a business relationship with the data subject or with a company represented by the data subject. This occurs particularly in the area of contractual and, upon request, also pre-contractual relationships (Article 6 paragraph 1 lit. b DSGVO). Specifically, the name of the data subject, his contact data (e-mail address, telephone number, address), account data, if necessary information on creditworthiness, if necessary social security data, information of the data subject in connection with the fulfillment of the contractual relationship, in the form of plant data, service data, documentation documents, documents and correspondence between SKE, the contractual partner, if necessary contractor and the data subject, delivery, sales and billing data are processed.
  • In addition, personal data is processed to the extent that this is necessary for the fulfillment of a legal and/or statutory obligation to which SKE is subject (e.g. retention and documentation obligations under the Austrian Commercial Code, the Austrian Federal Tax Code (BAO), reporting obligations as an employer to the social security authorities; Art. 6 (1) c DSGVO) or for the performance of a task in the public interest (Art. 6 (1) e DSGVO).   • The processing of the data is based on the consent of the data subject pursuant to Article 6(1)(a) DSGVO to process/store the data for the purposes of processing an inquiry, for the performance of a contract concluded with the data subject (Article 6(1)(b) DSGVO), on the basis of a legitimate interest (Article 6(1)(f) DSGVO) of SKE and/or in order to be able to process customer inquiries professionally, or more than one of these legal bases.
  • The data subject may revoke the consent to the processing of personal data at any time (Art. 6 para. 1 lit. a DSGVO).

  • SKE ensures the security of the personal data of the data subjects and has taken a number of technical and organizational measures for this purpose within the meaning of Article 32 of the GDPR, in particular encryption of the services using state-of-the-art encryption methods (e.g. SSL), user authentication controls, secure network infrastructures, restriction of access to personal data, network monitoring solutions, area-restricted alarm systems as well as video surveillance, employee behavioral instructions, obligation to data secrecy.

  • When a registration for an event is made by SKE, various personal data are collected and, if applicable, names and company affiliation are presented to the other participants (e.g.: in a list of participants). Apart from the categories of data already mentioned above, additional data may also be collected and processed, such as in particular account data (in the case of events with costs), time data or attendance times during the event.In the context of the organization and handling of internal and external events, SKE collects and processes the following categories of personal data:

    • Legal and tax advisors and experts for the examination, assertion, exercise or defence of legal claims,
    • courts to assert, exercise or defend legal claims.
  • Personal data may be transferred to countries outside the EEA for the performance of pre-contractual measures and/or in fulfillment of a contract with the data subject or the company represented by the data subject, in particular by group companies of SKE or due to the use in particular of cloud solutions for communication and collaboration, for video conferencing, for maintaining information and data security and for customer care. Where applicable, personal data may also be processed when used for promotional purposes on social media channels (e.g. Facebook, Instagram) or websites outside the EEA. Such transfer is primarily based on binding internal data protection regulations pursuant to Art 47 in conjunction with Art 46 (2) lit b DSGVO, adequacy decisions of the European Commission pursuant to Art 45 DSGVO;
  • Standard data protection clauses pursuant to Art. 46 (2) lit c and d DSGVO. In exceptional cases, a data transfer may also take place on the basis of Art. 49 DSGVO, on the one hand because the data subject has expressly consented to the proposed data transfer after having been informed of the potential risks to him or her of such data transfers without the existence of an adequacy decision and without appropriate safeguards, the transfer is necessary for the performance of a contract between the data subject and SKE or for the performance of pre-contractual measures at the request of the data subject, on the other hand the transfer is necessary for the conclusion or performance of a contract concluded in the interest of the data subject by SKE with another natural or legal person.

Storage period and deletion

  • SKE stores personal data for as long as the purpose of the processing exists, thus mainly necessary for the performance of a contract with the data subject or for compliance with a legal/statutory obligation or for the assertion, exercise or defense of legal claims or there is an overriding legitimate interest of SKE in the processing.
  • In particular, SKE must comply with the following statutory retention obligations or limitation periods:
    • Accounting, tax and customs law;
    • Obligation to retain data for tax purposes according to § 132 para. 1 BAO: 7 years, beyond that as long as the data is of importance for the tax authority in pending proceedings;

  • Contracts
    • Warranty according to § 933 ABGB: from handover 2 years (movable objects), 3 years (immovable objects);
    • Purchase price claim for movable property according to § 1062 in conjunction with § 1486 ABGB: 3 years;
    • Purchase price claim for immovable property (e contrario § 1486 ABGB): 30 years;
    • Claims arising from a contract for work and services pursuant to § 1486 ABGB (if the service was rendered within the scope of a commercial or other business operation): 3 years;
    • general damages according to § 1489 ABGB (compensation claims): 3 years (if damage and damaging party known) / otherwise absolute limitation period 30 years (e.g. in case of accidents at work iS § 1325 ABGB);
    • Liability claims according to § 13 PHG: 10 years.
  • SKE deletes the data of applicants who are not hired after seven months following the application process, unless consent has been given to keep records. If an employment relationship is established, SKE stores the applicant's data until it is terminated or, if the aforementioned purposes apply, beyond that time. In the case of consent, in particular when sending electronic messages, the data is stored until revocation by the person concerned, which is possible at any time, whereby the revocation does not affect the processing carried out until receipt of the revocation.

Rights of data subjects

The person concerned has the right at any time to:

  • information about his personal data processed by SKE;
  • Correction of this personal data if it is incorrect or incomplete;
